NEWS FLASH! - State v. Mirayes
On August 30, 2004, the prosecution dismissed the panhandling case against Richard Mirayes (State v.Mirayes, B04-12687), after conceding that the motion to dismiss on constitutional grounds filed by the law offices of Clayton R. Kaeiser, P.A. was disposative of the case.
Richard Mirayes is a street musician, who had been arrested in the Lincoln Road area of Miami Beach under the authority of the Miami Beach panhandling ordinance. Mirayes had been engaged in the non-aggressive solicitation of donations from passers-by who paused to listen to and enjoy his music.
Clayton R. Kaeiser, Mirayes' attorney argued that the Miami Beach ordinance was overbroad and a violation of the First and Fourteenth Amendments, since it punished non-aggressive solicitations such as that engaged in by Mirayes.
The City of Miami Beach agreed that its ordinance was unconstitutional and agreed to dismiss the case against Mirayes and all other people arrested under the ordinance. The City indicated that it was going to abrogate the ordinance and attempt to rewrite it so that it complies with the First Amendment standards established by federal and Florida courts.
